The Constitutional Court he ordered the Bogota City Hall that allows the realization of a bullfighting season in the Plaza de Toros la Santamaría from the capital of the country, and to refrain from committing any action that does not allow this type of event to take place in the city.
The decision forces the district entity to immediately allow the Plaza de Toros to return to being a place where bullfighting shows can be held and the preservation of bullfighting culture.
The foregoing occurred because the Court ordered compliance with a guardianship ruling that in 2013 had ordered that these activities might be carried out in the square, that the Bogota City Hall he had not complied, which caused bull lovers in the country’s capital to file an appeal for contempt.
“The District Recreation and Sports Institute failed to comply with judgment T-296 of 2013, with the abbreviated selection process for minor claims No. IDRD-STP-CAMEP-092-2021”, said the Court in its ruling, this because the IDRD He would have ordered in some studies that he carried out, the elimination of elements of bullfighting shows such as the rods, the banderillas and the death of the bull.
That would have denatured bullfighting activity in the capital of the country, so the right of people who like these activities to be able to enjoy them would be being ignored.
“This, because they not only succeed in supplanting the bullfighting spectacle with another radically different activity, but also because with this they invade the moments in which bullfighting is traditionally practiced and which are the only ones in which the Plaza can be used for said activity, so accordance with the conditions of the judgment C-666 of 2010, which referred to temporary conditions for its realization ”, says the decision that was made with a presentation by the magistrate Alejandro Linares Cantillo.
Therefore, the Court ordered IDRD that from the next bullfighting season it must: “deploy the administrative and contractual actions required to guarantee the continuity of the artistic expression of bullfighting in the city of Bogotá (Plaza de Toros de Santa María)”.
In this way, there will be a bullfighting show once more in the capital of the country, and it will be done under the conditions that guarantee the proper development of the show. In addition, the court clarified that this must be done: “according to the provisions of Law 916 of 2004; and strict compliance with the principles of public service and state contracting, which includes the structuring and opening of contractual selection processes under deadlines and in reasonable terms that allow interested parties to evaluate and prepare their proposals, as well as have time necessary to properly organize the event”.
The bullfighting show will return to Bogotá so that lovers of this activity can enjoy it once more. The ruling will surely provoke the reaction of animal sectors who ensure that the mistreatment of animals in the country ends.
