A seller seizes a car key that he sold to the buyer and received its price

A person displayed an advertisement on a social networking site offering to sell his car for 22 thousand dirhams, so another person contacted him to buy the car, and they agreed on the price, and the seller asked the buyer to transfer the amount to his driver’s account, due to problems in his bank account.
Accordingly, the buyer’s friend, who was with him at the time of inspecting the car, transferred the amount to the driver’s account, and the buyer received the car following agreeing to complete the assignment procedures with the competent authorities following the Eid al-Fitr holiday.
When the buyer assigned one of his friends to agree with the seller to complete the procedures, who in turn went to the defendant’s house to complete the vehicle assignment procedures, he was surprised that the driver seized the car key and refused to hand it over, protesting the anger of the vehicle’s owner because of its low price.
Before the Abu Dhabi Court for Family and Civil and Administrative Cases, the buyer filed a lawsuit in which he demanded that the seller be obligated to pay him an amount of 22,000 dirhams, as well as an amount of 2,743 dirhams for the repair value, an amount of 5,600 dirhams for the rental of a rented vehicle, and compensation for an amount of 20,000 dirhams, while obliging him to pay fees and expenses.
The court ruled to oblige the defendant to pay the plaintiff an amount of 24,586 dirhams, compensation of 2,000 dirhams, and obligate him to pay fees and expenses, and other requests were rejected.
In the reasons for its ruling, the court affirmed that the plaintiff’s request to oblige the defendant to return the value of the sale amounted to 22,000 dirhams, not to mention what was proven by the repair invoices submitted by the plaintiff and the legal translation, and since the court had ended the oral sales contract, which must return the situation to what it is and oblige The defendant to hand over the plaintiff the amount of 22,000 dirhams handed over to him, in addition to the value of the repairs 2,586 dirhams, bringing the total to 24,586 dirhams.
