Congress resumed its plenary session at 3:30 p.m. following the decision of the President of the Council of Ministers, Hannibal Torresto raise a question of confidence regarding a project that seeks to repeal the Ley 31399 what reinforces the limits of a referendum.
However, at the beginning of the session, the head of the Congress, José Williams Zapata, did not refer to the issue and put the request of the president Pedro Castillo to travel from November 24 to 29 to participate in the XVII Summit of the Pacific Alliance in Mexico and the IV Binational Cabinet between Peru and Chile.

The norm that the Government questions – regarding which it raised a question of confidence – modifies articles 40 and 44 of the Law on Citizen Participation and Control Rights (Law 26300). The changes approved by Congress reaffirm that any initiative for constitutional reform that is submitted to a referendum must first go through Congress (according to article 206 of the Constitution).

The question of confidence raised by the President of the Council of Ministers will be debated and voted on in the same session or in the following one, according to what is previously agreed by the Board of Directors or in the act of the Plenary of Congress.
The result of the vote will be immediately communicated to the President of the Republic, through an official letter signed by the head of Congress and one of the vice presidents.
If the plenary session denied its confidence in the Council of Ministers, the president will accept the resignation of the prime minister and the other ministers, which must take place immediately.
According to article 133 of the Constitution, “if the confidence is refused” the total crisis of the cabinet takes place (the resignation of all the ministers and the appointment of a new team).
Also, article 134 establishes that the president “is empowered to dissolve Congress” if said request is denied “to two Councils of Ministers.”

Last week, Aníbal Torres had announced a matter of trust, but for project 1704/2021-PE, which later was archived by the Constitution Commission. The Executive’s initiative sought to repeal Law 31355 that develops the issue of trust and which, on October 21, 2021, was approved at the insistence of the plenary session of Congress.
The prime minister had announced his decision to insist on this figure, following Parliament’s rejection of his first trade. According to Torres, a question of trust only arises when it is presented and supported in a plenary session.
Previously, the president of Congress, José Williams, had informed him that his first request “is not acceptable” because it refers to procedures that “correspond to the exclusive and exclusive powers” of Parliament.
Then, before a new letter from the head of the cabinet, Williams Zapata informed that he will be able to go to the Congress.
“I reiterate that any question of trust must be raised subject to our Fundamental Text, Article 86 of the Regulations of the Congress of the Republic, and Law 31355, Law that develops the exercise of the question of trust, as we stated in our previous communication”said the president of Parliament.
