Wien Energie: How Michael Ludwig makes himself vulnerable

The mayor of Vienna should have made the “huge amount” public immediately, says constitutional expert Bußjäger. But he does not believe in abuse of office.

The mayor has a total of 1.4 billion euros – 700 million on July 15, and then another 700 million on July 29 Michael Ludwig loaned to Wien Energie. This happened arbitrarily, without informing the municipal council or their own coalition partner – with the so-called emergency competence. Is Ludwig allowed to do that at all? What exactly is behind the emergency competence of the mayor? When can it be used, and was it justified this time?

Every mayor in Austria is granted emergency competence by the respective municipal ordinance in order to be able to act quickly in urgent cases or emergencies. A provincial governor does not have this, but since Michael Ludwig is also mayor of Vienna, he can make certain decisions on his own.
