Cassation appeals in the David BABALOLA and Laurent METOGNON cases

Appeals in cassation in the David BABALOLA and Laurent METOGNON cases, the Supreme Court of Benin examines,

decides and dismisses the appeals brought before it.

At the hearing of the criminal section of the judicial chamber of the Supreme Court of Benin opened this Friday, August 26, 2022, two new cases are listed which are particularly attracting popular attention. These are the files of David BABALOLA, former general manager of soneb and that of Laurent METOGNON, Secretary General of Fesyntra-finance in the CNSS-BIBE affair which opposes him to the Beninese State.

David BABALOLA, accused of embezzlement of public funds, was sentenced to 36 months in prison at the Cotonou Court of Appeal. But before the correctional chamber of the CRIET, he will see his sentence increased, thus going from 36 months to 10 years of imprisonment. The college of its lawyers, noting certain irregularities which it considers as a violation of the principle of the law, has therefore lodged an appeal in cassation before the Supreme Court of Benin once morest these various decisions and asks it to break them in the name of the law.

Laurent METOGNON’s lawyers also remain in the same pleading dynamic. Me BAPARAPÉ, one of his lawyers declares to have confidence in the high jurisdiction which, he says, will say nothing but the law to do justice to his client.

Under advisement, these cases which have been examined by the Court were settled during this hearing.

Thus, concerning the David BABALOLA and AZANDOSSESSI case, the Court, following deliberating in accordance with the law, for these reasons, accepts the present appeals in form, rejects them on the merits and places the costs at the expense of the treasury audience.

As for the Laurent METOGNON et Cie case, the Court, following having deliberated in accordance with the law, for these reasons, declares appeal number 021 of June 26, 2019 inadmissible, declares Alassane KEMOKO foreclosed in its appeal number 023 of June 26, 2019 , receives appeal number 26 of June 26, 2019 in form, rejects it on the merits and charges the costs to the public treasury.

We note that the decisions of the CRIET were not canceled by the Supreme Court. This means that the sentences pronounced by the Court of Repression of Economic Offenses and Terrorism are maintained for both David BABALOLA and Laurent METOGNON and their co-defendants.
