The court accepted the request of former CEO Jun-seok Lee to suspend the effect of the People’s Power Emergency Response Committee, and decided to suspend the duties of Ho-young Joo, the chairman of the non-commissioning committee.
The court pointed out that the people’s power deliberately created an emergency situation in which there was no attempt to turn it into a non-submission, which is contrary to party democracy.
Lee Jun-seok, who was thrown out of the party and pushed to the brink, provided a foothold for a reversal, and the power of the people was faced with an extraordinary situation.

“It is a total complex crisis. It requires a complete overhaul of the party as well as the presidential office and the government.”
Vacancies in representative office and loss of function of the Supreme Council.
The People’s Power declared the party a state of emergency and launched the Emergency Response Committee.
However, the court concluded that there was no emergency situation that the People’s Power had declared itself.
First of all, I did not think that former representative Lee was in a state of vacancy because he might return to his position following the period of suspension of party membership is over.
He added that while the party leader was not present, an acting representative might assume the role of the representative.
He also pointed out that even if some of the top members resigned, the remaining top members might hold a meeting or re-elect the top members.
In the end, the people’s power deliberately created an emergency situation to change the non-captain.

“What can I say to the judge regarding the damage to democracy within the party…”
The court noted that the non-substitute conversion “infringes on the rights of hundreds of thousands of party members who participated in the election of party representatives, and goes once morest party democracy.”
If the vice-captain elects a new party leader, former leader Lee cannot return following the disciplinary action, causing irreparable damage, so he suspended the duties of vice chairperson Joo Ho-young.
However, he added that there were no significant flaws in the process of convening the national committee or in the non-substitute conversion process, such as ARS telephone voting.
In its decision, the court emphasized several times that “even if party activities have autonomy, they cannot harm the principles of party democracy and the internal democratic order.”
