Customer protection strengthened online and offline

Wien. Belatedly, however, Austria passed the so-called omnibus guideline EU implemented. The modernized and tightened compliance requirements in the consumer sector affect almost all industries. They range from new requirements for price reductions and information requirements (e.g. for the operators of online marketplaces for the ranking of products) to new bans on misleading under the UWG. Violations can now also be very expensive – cross-border violations can result in fines of up to four percent of annual sales.

A bunch of legislative changes

In mid-July, the “EU Modernization Directive” (due to the large number of amended laws called the “Omnibus Directive”) was implemented by two “Modernization Directive Implementation Acts”. Specifically, the Consumer Protection Act (KSchG), the Distance and External Business Act (FAGG), the Act Against Unfair Competition (UWG) and the Price Labeling Act (PrAG) will be changed.
