a court ordered Geico insurance company to pay Missouri woman $5.2 million for proving she contracted a sexually transmitted disease while having sex in the car of a man insured by the company.
As established, your partner negligently infected you with the Human Papillomavirus (HPV), showing that the insurance policy covered “Injuries and losses”.
A three-judge panel of the Missouri Court of Appeals upheld the Jackson County Court’s decision. affirming an arbitrator’s conclusion that the woman was entitled to compensation.
Geico, the insurer, had rejected the woman’s initial settlement offer, and last year she appealed the settlement, but it was upheld by the Missouri Court of Appeals.
The insurer filed a federal lawsuit arguing that the woman’s claim is not covered by the man’s insurance policy, however, it failed.
The woman said she contracted HPV during unprotected sexual encounters in her partner’s vehicle in late 2017.despite the fact that he “was aware of his condition.”
The judge found that the woman’s partner “had been informed that her throat cancer tumor had been diagnosed positive for HPV.” The woman requested compensation for “past and future medical costs” as well as “past and future mental pain and suffering.”
Thus, a judge determined that he should receive $5.2 million in damages. He then filed a motion in the Jackson County Court to confirm the compensation.
