The data recorded on the mesvaccins.ch platform will not be sold to a private company. The Federal Commissioner for Data Protection and Transparency (PFPDT) ordered the destruction of this data, the processing of which would lead to attacks on the personality.
Since the bankruptcy of the mesvaccins.ch foundation in November 2021, the platform had been in possession of the sensitive personal data of the users of the platform, recalls the PFPDT on Tuesday in a press release.
As part of the procedure, the Berne-Mittelland Bankruptcy Office, acting on behalf of the bankruptcy estate of the mesvaccins.ch foundation, had considered selling this personal data over the counter to a private company.
However, in the final report of the fact-finding procedure on the platform published in August 2021, the FDPIC had found a lack of data integrity. An expert report drawn up three months later confirmed the serious shortcomings. These problems concerned both the content, with for example false entries for tetanus and Covid-19, and contact data.
No change
During the long period of time that has elapsed since the publication of the final report by the FDPIC, data controllers have not been able to find a solution to make their data available to users in a way that complies with the right of data protection, notes the PFPDT. The data controller assumes that any further data processing would lead to personality attacks.
He thus ordered last Friday to abandon the planned over-the-counter sale. He further recommended the deletion of all data. The Bern-Mittelland Bankruptcy Office has accepted these recommendations.
In a separate press release, the Federal Office of Public Health (OFSP) indicates that it takes note of this decision. The office regrets the loss of vaccination data for thousands of users and indicates that it has multiplied the steps to find a solution.
