DWANGO Holds a Press Conference on the Trademark Rights of “ゆっくり Tea Fan Drama” and Asks the Registrant to Give Up the Trademark Rights – Bahamut

In response to the recent registration of the trademark rights of the creative category of “ゆっくり Tea Fan Drama” by others, DWANGO, the parent company of the Japanese video creation and sharing platform Niconico, held a press conference yesterday. Measures such as opening a consultation window for users whose rights and interests have been damaged.

Since the birth of the label “ゆっくり”, it has accumulated more than 10 years of history, and has created more than 800,000 pieces. And “ゆっくり Tea Fan Drama” was originally a secondary creation category that was further extended from the “Oriental Project” series. With the familiar oriental characters such as Reimu and Marisa, they are transformed into Q version of the big head portrait, and all kinds of videos are born with the electronic synthesis sound of the good reading.

However, the name “ゆっくり Tea Fan Drama” was recently registered as a trademark by Japanese YouTuber “Yuzuha” and demanded a royalties of 110,000 yen a year, which caused a debate among all parties. Although Yuye later stated that it would cancel the part that charges royalties, it will still maintain the right to hold the trademark. Therefore, this incident not only attracted the attention of ZUN, the master of the “Oriental Project”, but also DWANGO, the parent company of Niconico, held a press conference on this topic yesterday.

As for the Lord of God, following consulting with a law firm last week, the lawyer believed that the “ゆっくり Chafan drama” regarding the use of “Oriental Project” for secondary creation is not actually bound by trademark rights, let alone “ゆっくり実” and “ゆっくり実”.ゆっくり Commentary” and other related categories of video creation. Lawyers also believe that it is very unbelievable to restrict the creative freedom of creators by registering trademarks.

As a Japanese video creation and sharing platform Niconico, it can also be said to be the place where the “ゆっくり” series made its fortune, so yesterday DWANGO held a press conference on the registration of a trademark for “ゆっくり Tea Fan Drama”. In the press conference, they stated that in order to provide creators with a safe and stable creative environment, they will take the following measures.

First of all, they will ask Yu Ye to give up the trademark right of “ゆっくり茶fanju”. If the other party refuses to give up the trademark right, DWANGO will further file a trademark invalidation trial once morest “ゆっくり茶fanju”. In addition, since Yuye has not given up the trademark rights of “ゆっくり茶 Fanju” until yesterday, he still has the right to demand royalties from users. Therefore, in order to prevent the other party from abusing their rights, DWANGO also opened a special consultation window to prevent anyone from being victimized in the future.

Finally, DWANGO said that since the “ゆっくり” series has a lot of extension categories and videos on the Internet, they will register a trademark for the series. At the same time, DWANGO’s statement also pointed out that their registered trademark is not for the right to use “ゆっくり”. But if the registered trademark is rejected by the Japan Patent Office, it means that others cannot register similar trademarks in the future. Even if the JPO finally agrees to register the “ゆっくり” series of trademarks, they will not exercise any rights once morest this trademark.
