They all claimed that they were informed by Apple staff during the inspection that the 2nd to 4th floors might not be entered, so they only watched and took pictures on the periphery of these floors.
Gu Yubing, the development manager of the science and technology park, pointed out that from 2015 to 2019, he inspected the premises involved in the case six times, and was led by an Apple employee to inspect. He was informed at that time that there were sensitive news materials on the second to fourth floors, and the other party did not want them to enter to view it, so he only watched and took pictures on the periphery of these floors.
Another senior manager of the Science and Technology Park, Hu Wenhao, also inspected the premises involved in the case in 2011, and was also told that the above-mentioned floor was “not allowed to enter”, but the other party did not explain the reason at that time. Hu said that some tenants or those with sensitive information during production would respect the tenant’s decision not to allow entry, but agreed that they might not be able to inspect some parts of the factory. However, the judge pointed out that Hu’s inspection was to confirm the tenant’s performance of the lease, and he should have the right to take the initiative to request inspection of the building. In addition, the judge pointed out that Hu did not enter these floors, but wrote that the utilization rate was 100% in the inspection report, which may be misleading. Hu explained that the main purpose of the inspection was to check the place where production was carried out. At that time, it was seen that all production was carried out at the place involved; he agreed that the use of this part may be misleading. The defense also questioned why Hu did not record the inability to enter certain floors in the report, but instead stated that the utilization rate was 100%. Hu reiterated that he had visually observed all the operations and operations of the office involved at the time, and under questioning, he finally answered that there was no need to record.
The defendants in this case are Lai Zhiying (74 years old) and Huang Weiqiang (60 years old), the two were charged with one count of fraud, alleging that the two together with Zhou Daquan and others, from January 2016 to May 19, 2020, to Hong Kong The Science and Technology Parks Corporation concealed the use of the premises at No. 8 Chun Ying Street, Tseung Kwan O Industrial Estate without entering into a lease; and Lai Zai alone faced one more count of fraud, accusing him and others in April 1998. From the 1st to December 31st, 2015, he used the premises involved in the case without concealing the proposal and the lease agreement.
