The Convention approved this Wednesday two paragraphs on copyright, which will be included in the draft of the new constitutional text. The norm states that “the moral and patrimonial rights over them are understood, in conformity and for the time indicated by the law.” On the other hand, the “protection of the various titles of industrial property protection” was rejected.
The Convention voted this Wednesday, in particular, the second replacement report of the knowledge systems commission.
The document included matters such as copyright, industrial property and recognition of memory and heritage.
One of the most celebrated initiatives was the one enshrines copyrightwhich was approved by 115 votes in favor, 13 once morest and 25 abstentions, passing to the draft of the new constitutional text.
“The Constitution ensures all persons the protection of copyright over their intellectual, scientific, and artistic works, including the moral and patrimonial rights over them, in accordance and for the time established by law, which shall not be less than the author’s lifehe points out.
Likewise, it is added that the Magna Carta “ensures the protection of the rights of interpreters or performers on their interpretations or executions, in accordance with the law.”

However, the plenary rejected two paragraphs that the proposal also contained. The first held that “The exceptions and limitations to these rights will be established by law and will ensure the exercise of cultural rights, the enjoyment of the benefits of knowledge and other fundamental rights.”
Meanwhile, the second paragraph rejected indicated that “The State shall adopt the necessary measures to strengthen and disclose the public domain.”
Finally, by 80 votes in favor, 50 once morest and 20 abstentions, “industrial property” might not pass into the draft constitutional text either.
“The Constitution ensures the protection of the various industrial property protection titles. The law will regulate the rights that are conferred on its owner, their duration and the limitations derived from their social function.Said this rule.
