Fatim-Zahra Ammor is preparing a restructuring of the legal framework of the social and solidarity economy

The Ministry of Tourism, Handicrafts and Social and Solidarity Economy is preparing a new study for “the restructuring and strengthening of the legal and regulatory framework of the social and solidarity economy in Morocco”.

The study was entrusted to the Southbridge A & I group and to the company Afrique Advisors, for an amount of nearly 4 million dirhams, financed by the French Development Agency (AFD).

The actors of the social and solidarity economy (SSE) have been calling for years to reform the legislation in this area. A draft framework law, drawn up on the basis of a previous study carried out by the cabinet Mazars, remained in the drawers of the ministry without going through the legislative process.

The objectives assigned to their mission as set out in the specifications are as follows:

– Develop a framework law to organize and structure the SSE sector and make it known and recognized as a component of the national economy, while improving its visibility for professionals and institutions.

– Put in place a system of governance that generates coherence, sustainability and efficiency in the activities of the SSE sector; which will make it possible to assess social and societal performance, and contribute to the effectiveness and efficiency of the components of the sector.

– Promote the organizations that make up the SSE sector, as important levers for national, regional and local development.

– Define and integrate new standards, procedures and rules to oversee the SSE sector, by clearly identifying the entities that fall within its scope, and establish their distinctive characteristics.

– Establish an administrative system of recognition, representation and quantitative and qualitative monitoring/evaluation of SSE organizations. This in order to be able to define the obligations related to the quality of governance and management in the sector.

– Integrate the gender approach in terms of parity into representations of the SSE.

– Define the eligibility criteria for actors likely to integrate the SSE, in particular social enterprises, so-called economic or development associations, etc.

– Redefine the scope of the social and solidarity economy, in particular social entrepreneurship, as well as the foundations in this sector.

– Strengthen social innovation within the territories.
