National Security Law Amendment Legislative Yuan Passed the Heaviest Sentence of 12 Years and 100 Million for Economic Espionage in the First Trial

[Reporter Yang Chengyu/Taipei Report]In order to further protect the competitiveness of my country’s high-tech industry and national economic interests, and to prevent the business secrets of the country’s core and key technologies from being infringed by China or foreign hostile forces, the Legislative Yuan’s Home Affairs Committee passed the National Security Law in the first instance. Draft amendments to the articles, adding “crimes of economic espionage” and “crimes of extraterritorial use of business secrets of key national technologies”. According to the draft, those who engage in economic espionage to steal secrets and divulge them to mainland, Hong Kong, Macao or foreign hostile forces can be sentenced to fixed-term imprisonment of not less than 5 years but not more than 12 years, and may also be fined NT$5 million to NT$100 million.

The Home Affairs Committee of the Legislative Yuan continued to review the draft amendments to some provisions of the National Security Law in a joint case today.

According to the explanation of the amendment, the competition between contemporary countries is no longer limited to military equipment, but also includes the struggle between various industries and technology under the relationship between the global market and industrial division of labor; and the concept of national security is not limited to the military, but extends to economic development. and the impact of industrial competitiveness on national development. In recent years, my country’s high-tech industry has been repeatedly attacked by competitors from foreign countries, China, Hong Kong and Macao, illegally poaching high-level R&D talents, and stealing the core technology of the industry, which has seriously affected the development and competitiveness of my country’s high-tech industry.

The draft clearly stipulates that no one may engage in acts of infringing on the business secrets of the country’s core key technologies for foreign, land, Hong Kong, Macao, foreign hostile forces or various organizations, institutions, groups or their dispatched persons established or substantially controlled by them. Violators may be punished. Fixed-term imprisonment of not less than 5 years but not more than 12 years may be combined with a fine of not less than NT$5 million but not more than NT$100 million.

In addition, the draft newly added the “crime of extraterritorial use of business secrets of national core key technologies”, which clearly stipulates that no one may intend to use the business secrets of national core key technologies in foreign countries, inland ports and Macao, and acts that infringe on the business secrets of national core key technologies. Violators may be sentenced to fixed-term imprisonment of not less than 3 years and not more than 10 years, and may also be fined not less than NT$5 million but not more than NT$50 million.
