The President of the Republic, Pedro Castillo once more faces an attempt to vacancy from Congress. His adversaries indicate that he has incurred in “moral incapacity”, for which he is not fit to continue being head of the Nation. A vote of two-thirds of the legal number of congressmen is required to vacate Pedro Castilloaccording to Constitution. For this reason, 87 votes are necessary in plenary to achieve the opposition’s request. The only vice president Dina Boluartewould assume command of the State if the presidential vacancy materializes.

According to previous counts, the opposition benches would not have enough votes to remove Pedro Castillo. The president would have the support of Free Peru (32 votes), Democratic Peru (7) and Together for Peru (5), in addition to congressmen from the Purple Party, Somos Perú and Alianza para el Progreso who might be added individually.

What does the opposition understand by “moral incapacity”?

According to the text of the vacancy motionthe “moral incapacity” is a “political solution to the protection enjoyed by the president so as not to be tried for crimes or infractions committed during his mandate.” The motion was accepted for debate with 76 votes in favor and 41 once morest.

The opposition points out that “in any presidential regime, the Constitution contemplates indeterminate clauses that allow the removal of the president in case of misconduct.” In that sense, they refer that said measure is the power of Congress and “implies a political assessment of the ethical and moral qualities” of the president in turn.

What are the arguments of the opposition to vacate Castillo?

The congressmen who presented the vacancy motion detailed 20 points in which they question different areas of the Castle Terrones management. From the beginning, they point out that the president incurred in “contradictions and lies” during the tax investigations in the cases of promotions in the Armed Forces and the award of a work to the company linked to Karelim López.

They also point out that Castillo appointed questioned ministers in the cabinet, like Carlos Palacios (Energy and Mines) and Hernan Condori (Health). Other questions that stand out in the motion are the alleged ‘shadow cabinet’ that would have advised him and the alleged meeting of Bruno Pacheco and Castillo’s nephews with businessmen.

Additionally, the president’s statements on CNN regarding granting an outlet to the sea for Bolivia are mentioned in the vacancy text. Likewise, the case of the meetings in Sarratea’s house and the alleged interference of Vladimir Cerrón in the Executive are other controversial points detailed in the measure.
