A 17-year-old boy “Xiao Yang” who was studying nursing in mainland China, was arranged by the school to work in an electronics factory in Jiangxi for just over a month. He died suddenly because of suspected overwork. Signing the “Intern Tripartite Agreement”, but not granting Xiao Yang’s sick leave many times, and the school and the factory have not fulfilled their compensation commitments so far, making the family furious.

According to “Upstream News”, Xiao Yang, who was suspected of sudden death from overwork, took a bus with more than 100 classmates on December 30 last year from a school in Yunnan to an electronics factory in Nanchang, Jiangxi for an internship called “social practice”. All students have signed a tripartite agreement with the school and the factory. Students can receive a monthly salary of RMB 1,850 (approximately NT$ 8,251), and if there is overtime, the overtime fee will be calculated separately.

However, Xiao Yang’s brother revealed that during the period from his entry on January 9 to his sudden death on February 11, “the working hours were as long as 12 hours a day, and he was also on night shifts”, and the rest time was all determined by the team leader. . As early as January 6, Xiao Yang informed his family that he was unwell and had vomiting symptoms, but he might not be treated because he was in isolation at the time. After that, his “three leave of absence” was not approved, which caused Xiao Yang to go to work while sick. He vomited blood on the evening of February 10, but because the nearby clinic was closed at that time, he was not sent to a major hospital for treatment until the next morning, and eventually died at 2 pm that day due to “respiratory failure”.

Xiao Yang’s brother said that when his younger brother was admitted to the hospital, he was also found to be seriously ill with a large amount of pericardial effusion and severe pulmonary hypertension. He denounced the factory for not approving his younger brother’s leave for three consecutive times in order to produce production capacity, which led to Xiao Yang’s death, and criticized the school angrily: ” Why do students go to the factory for an internship?” The students who participated in the internship also pointed out that because the factory stated that “absenteeism” would deduct 3 days’ salary for 1 day, no one dared to ask for leave, and during the Chinese New Year period, “most regular employees” They are all on vacation, which puts a lot of pressure on the work of the intern.” The student also said that he “did not take a day off in the first month of the internship.”

It is reported that following Xiao Yang’s family proposed compensation of RMB 660,000 (regarding NT 2.9 million) and 900,000 (regarding NT 4 million) to the school and the factory respectively, although they immediately obtained the promise of the school and the factory, but Xiao Yang’s brother pointed out that neither the school nor the factory has paid a dime since the compensation agreement was reached. In this regard, the factory stated that the school is responsible for all compensation issues at present, but the school opposed the students’ families following they reached an agreement but went back on it, which led to the breakdown of the compensation agreement at the beginning; however, Xiao Yang’s brother retorted that the factory first learned that After regretting the amount, they unilaterally asked them to negotiate compensation with the school first, and then accused the school of deliberately smearing the family members for “big money”, making this compensation dispute fall into the Rashomon.
