New Delhi: The Supreme Court has ruled that hotel owner Roy Vayalat and his friend Saiju Thankachan cannot be granted anticipatory bail in the Poxo case related to Hotel No. 18. Following this, the two withdrew their anticipatory bail application filed in the Supreme Court. The apex court bench comprising Justices Sanjeev Khanna and Bela M Trivedi said that following examining the CCTV footage and the statement of the victim, it might not intervene in the anticipatory bail application which was rejected by the High Court.
Siddharth Luthara, senior counsel appearing for Roy Violet, argued that the victim’s complaint was once morest the accused in the case, Anjali Rima Dev. Anjali was granted anticipatory bail by the high court. Luther also argued that Pokmon might not be prosecuted for telling them to dance.
However, the court noted that the victim was a 17-year-old boy. This is a serious case. The court said that the High Court had denied anticipatory bail following examining the victim’s confession. However, the apex court also directed that references in the judgment of the High Court denying anticipatory bail should not be considered when approaching the courts for permanent bail.
