A 30-year-old man accused of assaulting and killing his girlfriend at an officetel in Mapo-gu, Seoul was sentenced to seven years in prison in the first trial.
On the 6th, the 12th Criminal Agreement of the Seoul Western District Court (Chief Judge An Dong-beom) sentenced Mr.
In the sentence, the court said, “The serious result of the victim’s death has occurred, and the final sentence was decided in consideration of the fact that the accused sincerely apologized to the bereaved family and was not forgiven.”
However, he said, “The defendant is a lover and the victim, and although they often quarreled during dating, they did not have a continuous assault relationship before the crime.”
He also said, “It is difficult to admit that he intentionally killed the victim,” he said.
At a meeting with reporters right following the sentencing, the bereaved family said they hoped the prosecution would appeal. In the meantime, the bereaved family has been appealing that A should be charged with murder.
The Mapo date violence case, which drew national outrage, was an incident in which A assaulted his girlfriend Hwang Ye-jin and killed her at an officetel in Mapo-gu at the dawn of July 25 last year. Person A assaulted Hwang while arguing for notifying the people around her of her relationship with him.
After the incident, Hwang died on August 17 last year following being treated in a coma at the hospital for regarding three weeks.
According to the police, at the time of the incident, Mr. A assaulted Mr. Hwang several times, including pushing his head once morest the wall, and left Mr. Hwang unconscious. Also, immediately following the crime, Mr. A made a false report to the effect that ‘Mr. Hwang was drunk and fell and was injured.’
The police applied for an arrest warrant on the charge of ‘injury’ the day following the incident, but the court rejected it. Afterwards, the police re-applied for an arrest warrant on the charge of ‘injury and fatality’ following conducting additional investigations such as additional investigations of neighbors, cell phone forensics, autopsy of the National Forensic Service, and expert advice.
Last month, the prosecution requested the court to sentence A, who was handed over to trial, to 10 years in prison.
The prosecution said, “It is a serious crime when you look at the circumstances of the crime. “The victim’s family wants punishment, so severe punishment is inevitable,” he added.
A’s attorney said, “On behalf of the accused, I apologize to the victim’s family. We mightn’t come to an agreement,” he said.
