The woman is accused of endangering physical safety (§ 89 StGB) and child abduction (§ 195 StGB). There is already a trial date.
The trial once morest the mother of three will take place on March 11th, the state criminal court announced on Friday followingnoon in response to an APA request. The 38-year-old has been in custody for two weeks. A detention review date scheduled for today, Friday, is obsolete in view of the main hearing that has already been scheduled. The defendant remains in custody until her trial.
The mother of three – in addition to the four-year-old girl, the 38-year-old is the mother of a 13-year-old daughter and an eleven-year-old boy – had her custody provisionally withdrawn last year. Because the single mother was overwhelmed, her children are said to have had no structured daily routine and no adequate home suitable for children. In addition, the spokeswoman for the city of Vienna’s child and youth welfare service (MA 11), Ingrid Pöschmann, explained to the APA the previous week that they only attended school irregularly. There were also several reports of danger. The 38-year-old is also said to have contacted the authorities herself for help.
No more custody since June 2023
According to MA 11, the temporary withdrawal of custody has been in effect since June 2023. At that time, the children were taken to a crisis center. Immediately followingwards, the woman and her youngest daughter probably went into hiding. She is said to have not brought the little one back to the facility following a day’s visit. The two older ones ran away from a shared apartment, probably also to their mother.
According to the latest, reliable information from the APA, the 38-year-old was convicted of child abduction by the state court for the first time at the end of September. She was sentenced to nine months in prison, with her sentence being pardoned with a probationary period. Despite this, she still did not hand over her children to MA 11, the authority authorized to have custody.
Youngest daughter roped off
Finally, the police began searching for the missing children. In mid-February, the 13-year-old and the eleven-year-old were found in an apartment in Döbling, which the mother had only opened following Wega officials had threatened to force their way into it. However, the 38-year-old is said to have roped off her youngest daughter with sheets and taken her away in time or had her taken away.
The latest indictment now available relates to the child abduction of the four-year-old daughter and an incriminated offense period from December 21, 2023 to February 15. An older, legally binding criminal complaint that will be included in the upcoming hearing covers the period from September 25, 2023 – the day the woman was first convicted – to December 21.
