[단독]’Namyang Dairy Products 3rd Generation’ was arrested and prosecuted, but an office worker in his 30s for smuggling cannabis is suspended from prosecution. Why?

After reconciling with his father, who had been at odds with him, he was helped to settle in the United States
After returning home, the shock of the father’s ‘screaming death’ in front of the family
Anxiety due to collapsed family and burden of family business, drug abuse
Prosecutors do not punish the use of very small amounts and family history

A 30-year-old who used to work for an American company brought a large amount of cannabis that he used to smoke into Korea, but was caught by airport customs. Suspension of indictment is a decision in which the suspicion of a crime is acknowledged, but not brought to trial for circumstances. It is a contrary decision to the arrest and indictment of Mr. Hong, the grandson of Namyang Dairy Products founder and honorary chairman Hong Doo-young, on similar charges on the 15th of last month.

I had a feud with my father, who had different expectations, but following the reconciliation, my father passed away

According to the legal community on the 4th, Mr. A, an office worker in his 30s living in Seoul, went to the United States several years ago following having a severe disagreement with his father, a businessman who had high expectations of him. Mr. A dramatically reconciled with his father right before he got a job at an American company. His father, who had moved to the United States within a month for his son who would be struggling in a foreign country, took care of his own meals and laundry for him, helped him settle down there, and then came to Korea. However, following returning home, his father died a few days later in a car accident in front of his wife.

Mr. A, who suffered from constant insomnia due to the extreme stress of having to take care of his mother who collapsed in shock, his still young brother, and his father’s business, eventually attempted suicide out of burden. When her psychotherapy didn’t work too well, her American colleague suggested cannabis, and she used very small amounts. Then, she put it in her luggage to use in Korea, but was caught at the airport. At the time, what he possessed were 5 liquid cannabis cartridges, 5 cannabis tobacco, and a hemp grinder.

I tried cannabis for insomnia and anxiety, but improved with drug treatment

The family, who later learned of Mr. A’s insomnia and anxiety symptoms, took him to drug treatment, and Mr. A’s symptoms improved. Due to his use of only a small amount, the drug test also came back negative. Mr. A’s father’s business had a lot of foreign transactions, so it was necessary to build experience and networking through employment at a foreign company.

Family members, including the mother, bowed their heads saying it was their fault for not taking care of their children properly. The elderly Mr. A’s grandfather also lost his child in a terrible accident, and he submitted several petitions asking for an opportunity so that only his grandson’s path would not be blocked. In response, the Seoul Central District Prosecutor’s Office issued a disposition of ‘suspending prosecution under educational conditions’ earlier this year. Suspension of indictment is a decision in which the suspicion of a crime is acknowledged, but not brought to trial for circumstances.

“It seems to have taken into account sentencing factors such as conditions with a high possibility of returning to work as a healthy member of society”

Attorney Kim Woo-seok, a former branch chief in charge of this case, said, “It seems to be the result of considering various sentencing factors, such as the unfortunate personal history of Mr. A, the fact that he took only a small amount of drugs and came out with a negative result, and the high possibility of returning to a healthy member of society. ”he said.
